Mix Subject Q200 has the answer...

Miranda Question

I have a question for you people.

The cops drag a guy to the station and make him confess, in violation of his Miranda rights. From the confession, the cops obtain a search warrant. With the warrant they find a murder weapon.

Now, his confession is excluded, b/c of the exclusionary rule. But the gun is *in*, because 1) there is a valid warrant and 2) the fruits doctrine don't apply to evidence obtained from Miranda violations.

Is that right??? Please explain.
